Beachheads and Enclaves

Same-sex marriage and public acceptance of legal equality for LGBT folk has broken out of the beachhead phase; defenders of inequality have turned to erecting enclaves for discrimination like the failed “religious freedom” law in Arizona. Marijuana legalization is still in the beachhead phase. We’ll know it’s broken out when enclaves start being built against that. But redoubts almost never hold.

Prohibiting Prohibition: It’s High Time

We need to stop this insanity. Drugs are bad, but the War on Drugs is far worse. We should repeal this Prohibition as we did the last one. It really is beyond sane debate. The War has accomplished nothing good, and made many bad things worse.

Spring Cleaning

Time to rid ourselves of some laws that block up the hallways of our national home and impede the country’s progress. I have three that I would suggest hauling away.

Peccant Judges

Peccant judges have that effect on us; unless we demand inhuman judicial perfection on the one hand or endorse total judicial anarchy on the other, they force us to think in uncomfortable shades of gray. They pose big headachey problems. Which I guess is why in general we want our judges to be squeaky clean. Not because this is an assurance of great judging, but because peccant judges raise such unsettling issues, and we have enough on our plate.

Debatable Laws

Laws lots of people support and lots of people disagree with. How you do or do not comply helps determine how legitimate these laws are.

Unforgivable Laws

Laws that give law a bad name. They do not and cannot bind the conscience. The only problem: Everyone has his/her own list of unforgivable laws.
